Acceptance of Terms

Welcome to First Sleep School! By accessing or using our website [www.firstsleepschool.com] ("Site") and its services, you agree to comply with and be bound by the following Terms of Use Agreement ("Agreement"). If you disagree with any part of these terms, please refrain from using our services.

Amendments

First Sleep School reserves the right to update, change, or replace any part of this Agreement at its discretion. Please review this Agreement periodically for changes. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.

User Account

To access certain features of the Site, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Communication With Users

• ‍SMS Communication:
  First Sleep School may, in certain circumstances, initiate SMS communication with users who have provided explicit consent through email, phone call, or text for support purposes or occasional promotional updates. By using our services, you acknowledge and agree to receive such SMS messages.
• ‍Consent Confirmation:
  Upon receiving your consent, we may send a confirmation SMS asking you to reply with "Yes" to confirm your opt-in. This confirmation ensures that you have willingly agreed to receive SMS messages from us.
• ‍Support and Promotional Messages:
  SMS communication may be used for support purposes, such as resolving issues or providing assistance related to our products and services. Occasionally, we may send promotional updates about our offerings.
• ‍Opt Out Option:
  ‍You have the option to opt out of receiving SMS communication at any time. To unsubscribe, reply with "STOP" to any SMS message received. For further assistance, contact us at [email protected].
• ‍Standard Message and Data Rates:
  Standard message and data rates may apply to SMS communication, depending on your mobile carrier. Contact your carrier for information on applicable rates.

Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of First Sleep School and is protected by international copyright laws.

User-Generated Content

Users may generate content such as comments, posts, and interactions within online communities. First Sleep School reserves the right to moderate and remove any inappropriate or irrelevant content.

Use of Services

You agree not to use the Site for any unlawful purpose or to violate any laws. Prohibited activities include, but are not limited to, the following:

• Uploading or transmitting viruses or any malicious code.
• Collecting or tracking personal information of others without explicit consent.

Subscription and Payment

Certain services on the Site may require payment. Users are responsible for handling payments, membership programs, or pay-over-time options appropriately.

No Guarantee of Exam or Certification Outcomes

First Sleep School provides educational courses designed to support learning, professional development, and exam preparation. While many of our courses are aligned with national certification, credentialing, or licensure exams and are intended to help students prepare, completion of any course or program—whether partially or in full—does not guarantee exam passage, certification, licensure, or any specific outcome.

Examination results depend on multiple factors beyond course participation, including but not limited to individual study habits, prior education and experience, clinical exposure, test-taking skills, timing of exam attempts, and the inherent difficulty of the exam itself. Certification and licensure outcomes are ultimately determined by the applicable certifying or governing body, not by First Sleep School.

By enrolling in First Sleep School courses, students acknowledge and agree that exam success cannot be guaranteed and that responsibility for exam readiness and performance rests solely with the student.

Refund Policy

• Important Clarification:
  ‍Completion of any First Sleep School course does not guarantee exam passage, certification, or licensure. Refund eligibility is based solely on course completion percentage and the terms outlined below and is not contingent upon exam results or certification outcomes. For additional details, please refer to the “No Guarantee of Exam or Certification Outcomes” section above.
• ‍Eligibility for Refunds:
  Students are eligible for a full refund if they have completed less than 30% of the course content. A pro-rated refund will be offered for courses in which the student has completed between 30% and 69.9%. Once a student has completed 70% or more, no refund will be granted.
• ‍Method of Refund:
  ‍Refunds will be processed back to the original payment method used at the time of purchase. Refunds are typically completed within 7–10 business days after approval.
• ‍Continuing Education Credits (CSTE Credits):
  ‍CSTE credits are only awarded upon full course completion. If a refund, whether partial or full, is granted, no credits will be issued.
• Refund Requests Required
  Refunds are not automatically issued for account cancellations, course cancellations, subscription cancellations, payment plan cancellations, or termination of access for any reason. To be considered for a refund, a student must explicitly request a refund. Requests to cancel an account, course, subscription, or payment plan do not constitute a refund request unless a refund is clearly and expressly requested.
• ‍Clarification Period for Refund Requests:
  If a student requests cancellation of an account, course access, subscription, or payment plan and does not request a refund at the time of cancellation, the student has thirty (30) days from the date of cancellation to submit a written refund request specifying whether they are seeking a partial or full refund and for which payments. After the 30-day clarification period has passed, no refunds will be issued, and any refund request will be granted only at the sole discretion of First Sleep School, if at all.

Installment Plans

Some of our courses allow students to choose to pay for the course via a payment plan. Payment plans may also be referred to as pay-over-time plans, installment plans, and payoff plans. Please note: this is not a subscription plan and cannot be canceled like one. When you select a payment plan, you agree to pay the entire agreed-upon price in the scheduled installments until the balance is paid in full.

Completing the course early or deciding you no longer need it does not cancel your remaining payment obligation. All scheduled installments must still be paid.

Refund requests are subject to our Refund Policy. In general, if you have completed 70% or more of the course, you are not entitled to a refund. Any partial or full refund in this situation is granted only at the sole discretion of First Sleep School.

Missed Payments on Installment Plans

If any scheduled installment payment fails for any reason (e.g., insufficient funds, expired card), First Sleep School reserves the right to:

• Suspend access to your course immediately until all missed payments are paid and your account is current.
• Permanently revoke course access without issuing any refund.
• Withhold any CSTE credits for CSTE-approved courses until all payments are completed in full.
• Apply late fees at our discretion.
• Pursue collection of unpaid balances either in-house or through a third-party collections agency.

Students are responsible for ensuring their payment method remains valid and up to date during the installment period.

Indemnification

You agree to indemnify and hold harmless First Sleep School and its affiliates from any claims, losses, or damages, including legal fees, arising out of your use or misuse of the Site, violation of this Agreement, or infringement of any intellectual property rights.

Disclaimer of Liability

First Sleep School, its affiliates, and partners shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Site or its services.

Termination of Accounts

First Sleep School reserves the right to terminate user accounts for violations of this Agreement, fraudulent activities, or any other behavior deemed unacceptable by the platform.

Dispute Resolution

Any disputes arising under or in connection with this Agreement shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.

User Conduct Guidelines

Users are expected to adhere to conduct guidelines, including the prohibition of inappropriate or harmful behavior within the Site.

Accessibility

First Sleep School is committed to ensuring accessibility for individuals with disabilities and takes accessibility seriously in every aspect of what we do, including our website, educational content, services, and communications. We strive to comply with all applicable accessibility laws, regulations, and standards and continuously work to improve the accessibility and usability of our offerings.

Cookies and Tracking Technologies

The Site may use cookies or other tracking technologies. Users are informed about how these technologies are used, and consent is obtained if required by applicable laws.

Force Majeure

First Sleep School shall not be responsible for any failure to perform its obligations due to unforeseeable circumstances or "force majeure" events or Acts of God.

Age Restriction

Users under a certain age are not allowed to use the services. Steps are taken to prevent underage users.

Severability

If any part of this Agreement is found to be invalid, the rest of the Agreement remains in effect.

Governing Law

This Agreement is governed by and constructed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
